In court records obtained by WHBQ-TV, police state Fitzgerald admitted he ran over Smith, who he knew and allegedly did drugs with, after the victim, wearing a mask and armed with a baseball bat, approached his vehicle and smashed the driver’s side window.

According to Fitzgerald, he was attempting to “detain” Smith when he ran over him over with his SUV down the block from where he said Smith broke the window.
