Alex Corpus Moreno, 32, faces charges of vehicular manslaughter and DUI in connection with the June 11 incident at Agave Sports Bar & Grill in San Jose.

According to court documents and a police report obtained by The Mercury News, Moreno was allegedly intoxicated, used cocaine in the open and tried to remove a woman’s top before he was finally asked to leave the establishment.

Moreno and a 24-year-old woman left and got into a 2017 Chevrolet Silverado truck owned by his company, Quality Erectors and Construction, Inc.

Eyewitnesses told police the pair were in the vehicle for around thirty minutes. The woman allegedly told police she was performing oral sex on Moreno, who was seated in the driver’s seat, and she didn’t realize the vehicle had begun to move.

Witnesses said the pickup traveled 170 feet and as fast as 45 m.p.h. across the parking lot before it struck and pinned three people against a wall. A security guard had to get behind the wheel of the still-revving truck to reverse it and free the victims.

Diana Prieto-Chacon, 35, died three hours after the crash. Two men, in their 30s and 40s, suffered leg injuries but are expected to survive, according to The Mercury News.

Security guards pulled Moreno from the truck and held him for authorities.

“The last thing he remembered was [walking] from the restaurant to his vehicle,” police wrote in the report.

The woman, who police alleged at first tried to take the blame for the crash before backing off the claim, has not been arrested or charged with any wrongdoing.
