A probable cause affidavit cited by Fox News stated that the incident occurred at around 7:21 p.m., when the Fulton Police Department were called to a private residence for an ‘accident with injuries.’
A witness said, Nicholus Walton "became upset" and "struck" the man with his car. The victim later confirmed that Walton got furious after not receiving a tip and got into a verbal argument before he "intentionally drove his vehicle forward and struck him," "causing him to jump onto the hood to avoid further injury."
Surveillance video reviewed by authorities showed the Domino's driver "initiating the confrontation by yelling profanities" and calling the victim and the witness "f------ rude."
"What are you going to do, b-----? Come get me," the deliveryman stated before moving to his car.
According to the statement of probable cause, the driver got into his car and backed it up, reversing toward the roadway, while the unidentified victim was walking on the driveway without attempting to stop him.
"Walton — who was nearly entirely in the roadway —placed the vehicle in drive and accelerated forward, striking [the victim]. Walton then fled the scene at a high rate of speed," the statement of probable cause added.
Walton, who has a prior conviction of domestic assault and false imprisonment, later admitted to driving toward the man, but claimed he "did so to scare him."
"The defendant poses a danger to the victim and the community as he intentionally used a motor vehicle to strike the victim during a verbal altercation and then fled the scene without contacting law enforcement," the statement of probable cause added. "His actions demonstrate a disregard for the law and safety of others, indicating he may not comply with a summons."
Meanwhile, the victim sustained visible injuries to his hands and told officers the accident "caused him pain, and he believes he has scrapes on his shin."
A similar incident occurred in St Louis County on Wednesday when a man identified as Casey McBride struck an 85-year-old man with his truck, who was riding a bicycle.
The man, who was previously convicted of assault in 2013 after shooting at a neighbour, was charged with first-degree assault, fourth-degree assault and armed criminal action.
