A New Mexico man says he shot a homeless person in self-defense, but police say it was in cold blood and it was murder.

Around 10 a.m. Sept. 19, police said they responded to a fatal shooting in the southwest part of Albuquerque, New Mexico.

According to authorities, witnesses and video showed the driver of a white Jeep shoot a approaching the vehicle from the middle of the road.

The driver fled the scene, but police said 21-year-old Isaiah Luna was identified as the driver by his mother and girlfriend.

Luna later returned to police with his mother, who told officers that her son shot the man and the gun he used was in the vehicle, KOB 4 reported.

Authorities said Luna claimed he shot the man in self-defense after the homeless man punched him in the face. Luna then stated he would not speak with police any further without an attorney present.

Officials said surveillance video from the area did not show the homeless man hit Luna or attempt to get in his vehicle before the shooting.

Luna was charged with an open count of murder and was booked into the Metropolitan Detention Center, authorities said.
