Singer D4vd's lawyers demand public disclosure of evidence in Celeste Rivas Hernandez’s murder case

D4vd's lawyers want the evidence against him to be made public as soon as possible. The 21-year-old singer, whose real name is David Burke, has been charged with the murder of 14-year-old Celeste Rivas Hernandez, with whom he was allegedly in a s—-al relationship.

The defense attorneys have asked the prosecution to publicly present all the evidence they have against the accused. Burke’s lawyers say they are certain that the evidence will prove the singer’s innocence.

“We believe the actual evidence will show David Burke did not murder Celeste Rivas Hernandez. We would like to have the evidence come into the light of day,” defense attorney Blair Berk told the court during Burke’s arraignment on April 20.

The prosecution has agreed to present the evidence as Deputy District Attorney Beth Silverman responded to Berk’s request by announcing, “We’ll be very happy to put on the evidence that we’ve collected.” Silverman revealed that they have collected 40 terabytes of data during the investigation.

Unlike most defendants, Burke has exercised his right under the 10-day rule in California, which requires a judge to determine whether there is sufficient evidence to proceed to trial within 10 days of arraignment. The right forces the prosecution to present its evidence much sooner than usual.

Defendants do not usually exercise their right, so their hearings are pushed back, and their lawyers get more time to prepare. However, Burke’s attorneys argued that media reports suggested a secret grand jury had already heard months of testimony in the case.

Hence, they are demanding a public preliminary hearing. Burke’s next hearing is scheduled for April 23; however, it remains unclear whether the prosecution will present its evidence during the proceedings.

One piece of evidence has already been released publicly as an autopsy report from the LA County Medical Examiner was unsealed on April 22. The report disclosed Hernandez’s cause of death as two penetrating wounds to the upper body, allegedly caused by a sharp instrument.

Burke has been charged with first-degree murder with special circumstances, including lying in wait, murder of a witness, and murder for financial gain. He is also facing charges of continuous s—-- abuse of a child and mutilation of human remains. The singer has pleaded not guilty.

Hernandez’s remains were found in Burke’s vehicle

Investigation against the Feel It singer began in September 2025, after dismembered and decomposed remains of Hernandez were discovered from a Tesla vehicle registered in his name.

The car had been abandoned on a street near Burke’s Hollywood Hills home and was later towed to an impound lot, where workers reported a foul odor. According to the prosecution, Burke began a relationship with Hernandez when the latter was only 13. The two spent a significant amount of time together at the singer’s home.

Investigators believe that Burke decided to kill Hernandez after she threatened to expose their affair. Burke was concerned that public disclosure of his relationship with a minor would damage his reputation and music career, which allegedly motivated the crime.
