Teacher Accused of Abusing 10-Year-Old Student “Up to Five Times a Day,” Recording Alleged Acts

A 32-year-old elementary school teacher, Mahayla Benavides, has been accused of molesting and r----- a 10-year-old student from her class. There are also accusations that the special education teacher from Washington filmed herself performing certain s----- acts on the boy. During the act, she is seen taking the name of the boy, according to authorities.

Benavides, a special education teacher at Stevens Elementary School in Spokane, allegedly r---- the 10-year-old boy five times a day and also filmed the alleged crime on her phone.

Benavides allegedly molested the child, usually in the time-out room in the classroom, even when other students were present, the 10-year-old boy told investigators, according to the affidavit obtained by KXLY.

Benavides also allegedly showed s----- videos she took of herself while saying his name. Benavides also filmed herself performing s----- acts on him, according to the affidavit.

The “highly predatory” teacher used her position of power to s------- assault the 10-year-old boy, Spokane County Deputy Prosecutor Amanda Fry said during Benavides’s court appearance on March 13, according to the Spokesman Review.

The unidentified child told investigators he was abused almost every day. According to the boy, the abuse started around winter break. “Sometimes as much as five times a day,” the boy said.

The boy, whose identity has not been revealed, said the confrontations usually took place in a smaller room adjacent to the main classroom. The boy also mentioned that these confrontations lasted around five minutes because that is how long their breaks lasted. Benavides also told the 10-year-old not to tell anyone, otherwise she would get fired, the affidavit said.

The police said in the affidavit they found video evidence of Benavides appearing to perform a s----- act with the child inside the classroom.

The Spokane Police Department was contacted in late February by the principal of Stevens Elementary School, who reported the incident after one of the student’s family members brought it to her attention.

Benavides was immediately removed from teaching once the district learned about the allegations, a school district official said. Benavides was arrested on March 12 and faces charges with one count of child r--- and one count of child molestation.
