Just after 1 a.m. July 31, officers in Midland responded to reports of a person fatally shot. The victim, who law enforcement officials have not identified, was struck multiple times, including in the side and lower back, the Midland Reporter-Telegram reported.

Police took Nikolas Ty Moreno, 18, into custody for the fatal shooting and charged him with first-degree murder. Moreno allegedly told investigators he was driving in his truck with the victim and gave him acid, which, he claimed, caused him to trip and see demons.

The affidavit states Moreno at one point stopped and exited the vehicle. He allegedly claimed the victim moved to the driver’s seat and tried to drive away and Moreno, thinking the victim was “stealing his truck,” held on to the door.

The pair allegedly then got into an altercation over a gun, which fired several times during the scuffle, Moreno claimed, according to the affidavit.

The arrest affidavit states a second juvenile was also detained in connection to the crime and corroborated Moreno’s story about the victim dropping acid. The juvenile allegedly said he was in the truck and he shot the victim with a separate gun because he feared for Moreno’s life, the affidavit notes.

Police allegedly located the two weapons at a home belonging to one of Moreno’s relatives, according to the affidavit.

Moreno has bonded out of the Midland County Jail, the Midland Reporter-Telegram reported.
