13-year-old pregnant after rape at New Year's Eve party. 31-year-old man charged in connection to assault.

A 13-year-old Wisconsin girl was sexually assaulted during a New Year’s Eve party and now cops say she was impregnated during that assault.

The victim, her mother and grandmother reported the rape on Jan. 23, according to the Juneau County Sheriff’s Office.

The victim’s mother said the victim and other children were left in the care of Todd Sanborn, 31, on New Year’s Eve, police said.

The victim was sleeping on the couch when she woke up to Sanborn assaulting her. She tried to push him off of her, according to authorities.

As the investigation into these claims took place, Sanborn was taken into custody and the victim was confirmed to be pregnant, authorities said.

While in jail, Sanborn made several calls. Police said in one call he stated he did not sexually assault the victim, and in another call he said he “wouldn’t do anything like that.”

In two calls with his girlfriend, Sanborn denied sexually assaulting the victim and asked his girlfriend to pick up some items at his house “before someone else finds them” from a nightstand, authorities said.

These conversations prompted authorities to search Sanborn’s bedroom and they said they found a container of drugs, paraphernalia and glass pipes.

According to authorities, Sanborn admitted the drugs and paraphernalia belonged to him, but initially denied sexually assaulting the victim.

Sanborn claimed the victim and other children were at his house for New Year’s Eve. He said they spent the night watching movies, playing music and dancing. Sanborn admitted to being intoxicated during the night and giving an alcoholic drink to the victim.

Authorities later provided Sanborn with the positive pregnancy results and they said that is when Sanborn admitted to having intercourse with the victim, but claimed she initiated it.

Sanborn said he was drunk and did not know how the event took place due to blacking out. He then claimed he didn’t even realize they had sex until he woke up the next morning, according to police.

He stated he regretted what happened and that it was the only time they had sex. He also admitted to knowing the victim was 13 years old, police said. 

After another search of his bedroom, authorities found two pairs of female underpants, police said.

Another interview with Sanborn gave more details, as he still claimed he did not recall the details of the night, but again said the victim initiated the interaction, authorities said.

Sanborn said another child walked in during the encounter and was told to leave, after which he had sex with the victim, according to police. He said he did not use a condom and called the victim by his girlfriend’s name during the encounter, but knew the victim wasn't her. 

Sanborn admitted that one pair of underpants belonged to the victim and she gave them to him to keep, police said.

Sanborn was charged with first-degree sexual assault, sexual assault of a child under 16, two counts of bail jumping, possession of methamphetamine, THC and drug paraphernalia.
