The U.S. Attorney’s Office for the Northern District of California sentenced a 38-year-old man on April 18 after he was convicted of possessing child s--ual abuse material. The sentence was handed down by a senior judge, who emphasized that the court would not tolerate such offenses.

The suspect was indicted by a grand jury on July 31, 2024, and later pleaded guilty to the charges against him. Under California law, a person convicted of felony possession of child s--ual abuse material can face up to three years in state prison and fines of up to $10,000.

San Jose Resident Circulated Child Abuse Material Online

David Alvarez admitted owning five electronic devices with 960 files related to child s--ual abuse material. He also accepted the fact that he circulated these to others using social media and several kinds of messaging applications.

Additionally, Alvarez also generated screen recordings of a number of video chat sessions he had with these people. At one point, he played his collection of child s--ual abuse material to about seventy people in one go.

Investigators claimed that Alvarez in his online recorded sessions, asked an individual to mas***** next to their sleeping child. He also showed a clipping of a child’s se**** abuse and claimed that he did the same thing with his nephew once. Alvarez further exchanged explicit messages with minors who were as young as 15 years old. He also shared with them inappropriate pictures of genitalia.

David Alvarez was sentenced to 66 months in federal prison by Judge William Orrick. The judge also imposed 10 years of supervised release and ordered Alvarez to pay restitution to one of the victims.

The sentence was announced by attorney Craig H. Missakian along with Homeland Security Investigations Special Agent Jeff Brannigan. Alvarez is scheduled to begin serving his sentence on July 10, 2026.

The sentencing comes amid another recent child sexual abuse material investigation in California. On May 14, authorities arrested a 55-year-old man from Marysville following a cyber tip that identified him as a suspect in a child abuse material possession case.

Robert Anthony Fiore was arrested and charged with multiple felony counts related to the se***** exploitation of minors. The man admitted to being in contact with multiple children, some of whom were as young as 12 years old.

Prosecutors alleged that Fiore was in possession of a total of 50 videos and 242 images of child se**** abuse. They claimed that the suspect willingly established contact with the minor victims. By November 2025, Fiore pleaded guilty to his crimes and faced imprisonment behind bars for three years.

While delivering the verdict, the Seattle federal court judge underlined how any amount of prison sentence would never be sufficient to undo the crimes the accused has committed against children.

The judge further claimed, “Those who collect and share images and videos of children being r**** and tortured further a market that thrives on the se**** abuse of children. The collection of this material drives demand for new material and normalizes horrific acts of se**** exploitation. And it subjects victims of child abuse to perpetual re-victimization, knowing that the digital record of their worst moments forever travels the globe to satisfy the se**** appetite of child predators .”
