‘Auntie Loves You’: Jessica Moreno Shares Heartbreaking Message After Nephew Killed By His Foster Brother

The aunt of a two-year-old boy who was s------- assaulted and killed by his foster brother has spoken out about the heartbreaking tragedy.

Jessica Moreno, baby Jaxon’s aunt, a day before the child’s death on April 9, said, “My nephew is on his way to heaven to be with his mama. He officially has no brain activity."

Moreno recounted the tragedies her family faced over the past year. “Over the last year and a half I have now lost 4 of my immediate family members,” Moreno said. “Something has to give for our family. I will not go into what happened as there is a huge investigation and we only know minor details. Life has been so unfair to him since the start. Just know we will get Justice! We Love You Jax.”

The child was repeatedly assaulted since he was placed in the foster family home in February.

Moreno said that she and her sister Riley Wallace had been fighting hard to gain full custody of their nephew Jaxon.

“How does a person even begin to heal from something traumatic like this? I haven’t even grieved My parents or Jax’s mom because they just keep happening one right after the other,” Wallace said. “Laws need to change.”

The San Jose Police Department found Jaxon’s bruised and battered body on Easter Sunday on April 5, 2026.

Evidence showed that the child, who is also the cousin of the suspect, had been repeatedly assaulted, s------- and physically, since he was placed in the foster family home in February.

Case Details

On April 20, the Santa Clara County District Attorney’s Office charged the foster brother with baby Jaxon’s death.

The San Jose man, who was a minor at the time of the Easter Sunday murder, was charged in juvenile court. The DA’s Office is seeking to transfer the case to adult court, according to the Santa Clara County office.

Additionally, prosecutors charged the suspect, who cannot be identified by the DA’s Office owing to a court order, with nine new felony charges, including child assault causing death and assault with a hair tie.

Multiple counts of s----- assault, including forced sodomy, have already been filed against the suspect.

If his petition is found true in juvenile court, he could face seven years in secure track, a locked facility for juveniles who have been adjudicated for serious crimes. If the case is sent to adult court by a judge, he could face many years in prison.

Jaxon was placed into foster care with his aunt following his mother's passing.

District Attorney’s Statement

“Today, we sadly add the name of Baby Jaxon alongside Baby Phoenix and others on a list of children whose short lives have been snuffed out through cruelty and recklessness,” Santa Clara County District Attorney Jeff Rosen said. “We are left with broken hearts and serious questions about who was watching out for the safety of these extremely vulnerable children.

“Jaxon will never have a chance at life. Jaxon will never have any way to tell his own story. My Office will speak for him and all the lost children as we seek justice.”

The investigation into baby Jaxon’s death is ongoing, and a full autopsy is still pending.
