The fatal shooting on the set of Rust in 2021 changed the lives of everyone involved in the production and reignited debate over gun safety standards in Hollywood.

Cinematographer Halyna Hutchins was killed after a revolver held by actor Alec Baldwin discharged a live round during a rehearsal in New Mexico. Director Joel Souza was also injured in the shooting.

The shooting happened on Oct. 21, 2021, at Bonanza Creek Ranch near Santa Fe. According to investigators, Alec Baldwin was rehearsing a scene with what he believed was a prop gun when the revolver discharged, striking cinematographer Halyna Hutchins in the chest before wounding director Joel Souza in the shoulder. Hutchins later died in hospital.

The incident shocked the film industry because live ammunition is not supposed to be present on a movie set. Investigators later focused on determining how the live rounds ended up on set and whether safety protocols had been ignored.

Baldwin repeatedly denied pulling the trigger. In an interview with CBS News, his legal team said he relied on crew members who told him the gun was safe. His attorney, Luke Nikas, said Baldwin “had no reason to believe there was a live bullet in the gun – or anywhere on the set.”

The criminal investigation led prosecutors to charge Baldwin and film Hannah Guttierrez-Reed with involuntary manslaughter in January 2023. Prosecutors said that a major safety failure led to Hutchin’s death.

The case against Baldwin took several turns. Charges were first dropped in April 2023 after new evidence was investigated. But the actor was indicted again in January 2024 after forensic experts claimed that the revolver could not have fired without the trigger being pulled.

Gutierrez-Reed was the first to go to trial. In March 2024, a jury found her guilty of involuntary manslaughter. She was sentenced to 18 months in prison, and the prosecutors said she failed to follow basic safety rules and also brought live ammunition onto the set.

Meanwhile, Baldwin’s trial began in July 2024 in New Mexico. Prosecutors argued that he acted recklessly by pointing the gun towards Hutchins during rehearsal and failing to perform proper safety checks. The actors' lawyers fought back, seeing that the actor trusted professionals hired to handle weapons on set.

In a twisted event in the courtroom, Judge Mary Marlowe Sommer dismissed the case against Baldwin after his legal team accused the prosecutor of withholding evidence in connection with live ammunition. The judge ruled that authorities had failed to properly share evidence with the defence, and the dismissal was made “with prejudice,” meaning the case cannot be filed again.

As the ruling was made, Baldwin appeared emotional inside the courtroom and later hugged his family members after the decision was made.

As reported by Business Insider, even after the criminal case ended, the legal battle did not fully disappear. Hutchins' family continued to pursue civil lawsuits against Baldwin and others connected to the production. Attorney Gloria Allred represents the family members of Hutchins. She said the dismissal is not exoneration.

At present, it was reported by the BBC that a judge has ruled for the case to go to trial. It is filed by Serge Svetnoy, who worked as the lighting technician on the film, and he alleges that Baldwin was negligent leading up to the shooting.

The tragedy also forced Hollywood to rethink on-set gun safety. Because of the Rust shooting incident, several productions stopped using real firearms on the sets.
